The below detailed Privacy Policy (hereinafter referred to as PP), relating to the collection, storage, use, transfer and protection of personal data collected by the company, applies to you as a user (hereinafter referred to as user, you or your ), who in any manner makes use of the websites www.mompluss.com and/or www.mompluss.in and/or the Mobile Application “MomPluss” (hereinafter referred to severally and jointly as portal). The portal includes any softwares, techniques, designs, features, contents, tools and processes used to create the portal, as well as any data available in them (hereinafter referred to severally or jointly as product). The portals and the products belong exclusively to Aayu Analytics Pvt. Ltd. having its registered office at 40/203 (FF), C.R.Park, New Delhi – 110019, India (hereinafter referred to as AAPL, company, we, us or our) or its duly contracted licensors and partners, wherever specifically stated, and are protected by applicable intellectual property laws.

The company through its products aims to enable the user to identify and access appropriate healthcare resources, including but not limited to, healthcare information, professionals and services (hereinafter referred to severally and jointly as service) for various people (hereinafter referred to as profiles), whose details are recorded by the user on the portal under his or her account. In order to optimize the services offered through its products on the portal, the company needs to collect personal information related to the users and the profiles created by the users. The registration is only a one time process and a user who has previously registered shall be able to login into his / her account on the portal using the same credentials as provided during the registration process to become a registered user (hereinafter referred to as registered user) on the portal. For the purposes of the PP, personal information (hereinafter referred to as information) shall mean and include information that relates to a natural person, which, either directly or indirectly, in combination with other information available or likely to be available to the company, is capable of definitively and uniquely identifying such a person.

Please go through the PP, also available at www.mompluss.com/privacy-policy, before you access the portal, use any products or avail any services offered through us. By registering on the portal, you irrevocably accept all the obligations stipulated in the PP and agree to abide by them. Accessing the portal through any medium, including but not limited to access via mobile phones, smart phones and tablets, is also subject to the PP and supersedes all previous oral and written privacy policies (if any) agreed between you and us. Furthermore, by using the portal, you also confirm your agreement to the Terms and Conditions of Service (hereinafter referred to as TCS and available at www.mompluss.com/terms-conditions), which is hereby incorporated by reference herein. It is your responsibility to review the TCS and the PP periodically to ensure that you are aware of any changes therein.

The Privacy Policy states our practices as implemented in the products to ensure the privacy of the info shared by the users, both non-registered and registered, including –

  1.  Types of Information Collected and Methods of Collection

1.1 The company collects information from users during the “Register”, “Create Profile”, “Edit Account” and “Edit Profile” process on the portal. The company is the sole owner of the information collected through the portal and will not sell, share, transfer or rent any such information to any third party in a manner different from what is disclosed in the PP and TCS. The company reserves the rights to collect, disseminate and sell or otherwise disclose non-personal information provided by users either individually or after aggregation and/or analysis.

1.2 During the “Register” process users are required to provide their personal information (such as name, e-mail address, mobile number etc.) and the products clearly indicate the purpose whenever such information is requested. A verification code in the form of a One Time Password (OTP)is used to confirm the validity of the details provided by the user, wherever relevant and feasible.

1.3 Every device connected to the Internet is given a unique set of numbers that serve as its Internet Protocol or IP address. When the users access our portal, our web servers can automatically recognize their IP address. The IP address reveals no information about the user other than the IP address of the device from which he or she has accessed the internet and our portal.

1.4 For the purposes of inviting new users to the portal, registered users will be given the option to refer such new users to the company’s portals by importing or otherwise inputting the email addresses or mobile number of such new users in the products. Such information will be only used for communicating the invitation extended to the new users.

1.5 The company encourages parents and guardians to supervise the online activities of their minor children and consider using parental control tools available from online services and software manufacturers to help provide a child-friendly online environment. These tools also can prevent minors from disclosing their name, address, and other personally identifiable information online without parental permission. Although the products are not intended for use by minors, the company will ensure the privacy of any data inadvertently provided by minors.

1.6 To be completely removed from the company mailing list, you may send an email to support@mompluss.com. Please be aware that this may prevent or severely limit us from keeping you informed about key transactions on your account, some of which may be related to the security of your account or be required to perform certain actions on your account. If you are using an e-mail forwarding service or other similar service please make sure to include the correct e-mail address or addresses.

  1. Protection of  Information

2.1 The company will take all necessary precautions to protect your personal information both online and offline. An employee of the company will neither have knowledge of your password nor will ask you to disclose it. It is important for you to protect your account against unauthorized access by safeguarding your password and access to your computer when you are logged in. Be sure to completely log off from the portal when you are using a shared computer. The company will also take necessary precautions to protect your personal information offline. Access to your personal information offline will be limited to specific employees, agents or partners and third parties with whom we are working and who the company reasonably believes will need that information to provide services to you. However, the company will not be responsible for the confidentiality, security or distribution of your own personal information by our partners and third parties, outside the scope of our agreement with such partners and third parties.

2.2 The portal may contain links to other third party sites. The third party sites are not necessarily under the control of the company. Please note that we will not be responsible for the privacy practices of such third party sites. The company encourages you to be aware when you leave the portal and to read the privacy policies of each and every third party website that collects personal information. If you decide to access any of the third-party sites linked to the portal, then you do so entirely at your own risk. Any links to any partner on the portal is the responsibility of the linking party, and company shall not be responsible for notification of any change in name or location of any information on the portal.

  1. Use of Collected Information

3.1 The company does not collect any personal health information of the users or the profiles related to their account, except when the users explicitly consent to share such personal health information on the portal. You understand that you may have the option of uploading your health / medical information on the portal in order to create a repository, enable analysis and / or consolidation of such data on the portal for gaining additional insights, provide any healthcare professional or service provider, specifically permitted by you, access to relevant information.

3.2 While the company takes utmost care with respect to the security of the information you decide to upload, you understand that any information that you disclose on the portal is at your own risk. By uploading / sharing / disclosing your medical information on a portal, you hereby give your consent to us to store such health / medical information on our servers, both physical and on the cloud. We will retain such medical / health information for as long as it is needed to fulfill the service you seek to avail on the portal. If you choose to delete your account or a related profile, we will retain the right to delete such medical / health information without informing you.

3.3 There might be some latency in deleting medical information of a user or related profile from our servers and backup storage after you have chosen to delete your account or related profile. We may, at our sole discretion, choose to retain any information in our archives in order to comply with our legal obligations, resolve disputes or enforce our agreements.

3.4 The company does not collect or maintain information that would associate a submission with a specific patient or individual. The Health Insurance Portability and Accountability Act of 1996 (HIPAA) privacy rule, which took effect on April 14, 2003, allows for the use of de-identified health information so long as identifiers have been “stripped” and a key is not disclosed that would allow the information to be re-identified. The company does not possess a key to re-identify patient data.

3.5 Information collected from you may be transferred to a third party as a result of a sale or acquisition, merger or bankruptcy involving the company.

3.6 A cookie is a small piece of data that is sent to your browser from a web server and stored on your computer’s hard drive. A cookie cannot read data off your hard disk or read cookie files created by other sites. Use of a cookie is in no way linked to any personally identifiable information while on the portals. Once you close your browser, the cookie simply terminates. For instance, by setting a cookie on your browser, you would not have to login with a password more than once, thereby saving time while on the portals. You can choose whether to accept cookies by changing the settings of your browser. You can reset your browser to refuse all cookies or allow your browser to show you when a cookie is being sent. If you reject the cookies on the websites, you may still be able to use the portals, but it shall be limited to certain minimal functionality. The only drawback to this is that you may be limited only to some areas of the portals or limited to certain functions of the portals. Some of our business partners may use cookies on the portals. Please note that we have no access to or control over these cookies.

3.7 The company may use IP addresses to analyze trends, administer the site, track your movement, and gather broad demographic information for aggregate use.

  1. Sharing and Disclosure of Information

4.1 The company may share aggregated demographic information with the company’s partners. Such information will not be linked to any personal information that can identify any individual person. The company shall not be liable for the transfer of any personal information resulting from loss or distribution of data, the delineation or corruption of storage media, power failures, natural phenomena, riots, acts of vandalism, sabotage, terrorism or any other event beyond company’s control.

4.2 The company may partner with third parties to provide specific services. When you sign up for these third party services, the company may share names, or other contact information that is necessary for the third party to provide these services. According to company’s contractual arrangements with parties, these parties are not allowed to use any personal information received from the company except for the explicit purpose of providing these services.

4.3 The company maintains a strict “No-Spam” policy, which means that the company does not intend to sell, rent or otherwise give your email address or mobile number to any third party without your consent.

4.4 The company takes your right to privacy very seriously and has taken measures to protect and safeguard your personal information. The company will however disclose your personal information, in the event that it is required to do so by law, rules, regulations, law enforcement actions, demands of governmental officials, legal authorities or such other similar requirements.

4.5 When you participate in a group on the portal, known also as forum, community or by any other name whatsoever, to poll votes, post comments or undertake any other such activity, your real name, pseudonym and IP address may be recorded for purposes of maintaining your own account within such groups and for preventing abuse of the groups. This information is not used to personally identify you outside the portal groups. In order to diffuse the information in the portal’s forums to a wider audience, the company may, from time to time, collect some of your postings and group them together to use in a specific publication, print, electronic mailing or other public dissemination. At no point however will your real name or IP address be revealed in any publication. In addition, when your postings are used in this fashion, they may be edited to fit with the general content of the publication being prepared.

4.6 It is important to remember that whenever you voluntarily disclose personal information in a forum, in a message including an e-mail or elsewhere on the portal, that information can be seen, captured and used by others. If your personal information becomes accessible to the public, you may receive unsolicited messages from other parties in return. You are solely responsible for maintaining the secrecy of your personal information.

4.7 Groups are intended only for the registered users of the portals, for undertaking personal activity and may not be used either for commercial purposes or for organized political activity.

  1. Correcting Inaccuracies

5.1 If any personal information related to a user or a linked profile changes, then the user can update the same on the relevant page of the portal. If a user no longer desires to use the portal, then the company will endeavor to correct, update or remove any personal data, provided to company by the user for the related account.

5.2 We may update the PP at any time, with or without advance notice to the users. In the event that there are significant changes in the way we treat your personal information, or in the PP, then we will display a notice on the portal or send you a communication, so that you may review the changed terms prior to continuing to use the portals. As always, if you object to any changes to our terms, and you no longer wish to use the portal, then you may contact us to deactivate your account.

5.3 Unless stated otherwise, the PP applies to all information that the company has about you and the profiles related to your account. Using the services on the portals or accessing the portals, after a notice of change has been sent to you or published on our portals, shall constitute your consent to the changed terms.

5.4 As and when necessary, the company may send you portal and service announcement updates. You will not be able to unsubscribe from the service announcements, which contain important information about the portals. The company will communicate via e-mail to provide the requested services and to resolve issues relating to your account.

By using the products, you consent to the terms of the PP. The company reserves the right, at its sole discretion, to change, modify, add or delete portions of the terms of the PP at any time as long as the user is also duly informed about the updated PP.
